The Supreme Court has delivered a significant ruling supporting a woman panchayat sarpanch from Maharashtra, reaffirming her right to serve following challenges to her election. A bench consisting of Justices Surya Kant and Ujjal Bhuyan expressed strong support for Manisha Ravindra Panpatil, who was elected as the sarpanch of Vichkheda panchayat in Jalgaon district in February 2021.
During the judgment, the court highlighted the resistance faced by Panpatil due to her gender, stating that some village residents struggled to accept a woman in a decision-making role. The court underscored a concerning pattern of bias that obstructs women’s representation in public office, particularly in rural areas.
Despite accusations against her regarding land encroachment and living situations, Panpatil clarified she resides in rented accommodation with her family. However, these allegations led to her disqualification by the District Collector, which was upheld by the Divisional Commissioner and the Bombay High Court.
In response, the Supreme Court criticized the handling of her case, asserting that the removal of an elected representative should not be taken lightly, especially when it pertains to women who have triumphed over significant obstacles to achieve public office.
The court remarked that the attempts to disqualify Panpatil appeared unfounded and were akin to “grasping at straws,” indicating an underlying systemic issue of discrimination against women in governance. The justices emphasized that such bias undermines national efforts towards achieving gender parity and women empowerment.
Ultimately, the Supreme Court reversed the Bombay High Court’s decision from August 3 and reinstated Panpatil in her role as sarpanch until the end of her term.
