A new lawsuit alleges OtterBox’s failure to replace or repair defective cases violated consumer protection laws and warranty statutes

A class action lawsuit has been filed against Otter Products, LLC d/b/a OtterBox (“OtterBox”) on behalf of consumers who purchased OtterBox smartphone and tablet cases and did not receive warranty replacements or repairs. The case was filed on behalf of plaintiffs who purchased Otterbox Smartphone and Tablet Cases, for whom OtterBox failed to honor its warranty obligations, leaving consumers without the protection they were promised.
Despite offering warranties that assured consumers their cases would be replaced or repaired if defective, OtterBox allegedly engaged in deceptive practices by failing to follow through on these commitments. Plaintiffs relied on OtterBox’s marketing and warranty assurances when purchasing these cases, only to find themselves without recourse when defects arose.
Consumers who purchased OtterBox products expected durable protection for their devices. Many were instead left frustrated when the company refused to honor its warranty policies. Plaintiffs argue that OtterBox’s actions constitute unfair business practices and deceptive trade practices.
