Surabaya, ECNETNews – Investigators from the East Java Police’s Criminal Investigation Directorate have elevated the status of the Certificate of Building Use Rights (HGB) case in the Sidoarjo maritime area to the investigation stage. They are currently gathering evidence to identify suspects in this case.
East Java Police’s Criminal Investigation Directorate Chief, Commissioner Farman, reported that investigators uncovered evidence of criminal elements in the case after questioning 14 witnesses, including representatives from two companies holding HGB, PT SIP and PT SC. Additional supporting evidence was also gathered.
“The HGB case in Sidoarjo has moved to the investigation stage. No suspects have been named yet,” Farman stated in an announcement received on February 21, 2025.
Farman elaborated that the HGB certificates were issued based on land history certificates, which appear to have been fraudulently created. These certificates are necessary for requesting land rights from the local ATR/BPN land office.
With these certificates, the BPN issued HGB for three parcels of land in the Sidoarjo maritime area. The land history certificates were reportedly created by the village head in 1996.
“The content appears to be falsely represented, used for land registration. The issuance of these HGB may result in losses for individuals who hold rightful claims, including several fish farmers,” Farman added.
The spotlight fell on the three HGBs in Sidoarjo after a recent social media post highlighted their existence in the marine area a few weeks ago. Initially, these HGBs were alleged to be located in the Eco Tourism Mangrove area of Gunung Anyar, Surabaya, but it was later determined that they fall under the administrative jurisdiction of Sidoarjo.
According to the bhumi.atrbpn.go.id site, one parcel of land extends from the Sedati sub-district into open sea with a Land Identification Number (NIB) of 00182, covering an area of 2,851,652 square meters. The second HGB is registered with an NIB of 00030, spanning 1,523,655 square meters, situated in the marine area while slightly encroaching on Sidoarjo land.
The East Java BPN office has acknowledged these findings and confirmed that the three land parcels are currently held by two companies. The head of East Java BPN, Lampri, emphasized that strict action will be taken if the issuance of these HGBs is found to violate existing regulations.
