German singer Alice Merton has filed a lawsuit against Kanye West for alleged copyright infringement, claiming that he used her song “Blindside” without permission in his track “Gun to My Head.” Merton is pursuing legal action and seeking damages for this purported violation.
Reasons Behind the Lawsuit
The lawsuit, initiated on March 25, accuses West of incorporating elements of “Blindside” into “Gun to My Head” without obtaining the necessary clearance. Merton declined West’s request to use her song in February 2024, citing her personal beliefs and her reluctance to be associated with West due to his controversial history of antisemitic and racist statements. Despite her refusal, West showcased “Gun to My Head” during his Vultures album event in December 2023, raising concerns among fans regarding the unauthorized sampling.
Following her refusal to grant clearance, Merton reportedly faced backlash, including harassment and threats from some of West’s fans, which led her to feel unsafe about her upcoming tour dates in the U.S.
In August 2024, BMG, representing Merton, issued a cease-and-desist letter to West demanding that he cease the use of the sample. The complaint alleges that West did not respond to this letter. Merton and the other plaintiffs are now seeking injunctive relief, damages, and a jury trial to address the breach of copyright and its repercussions.
Merton’s legal team asserts that West’s actions constitute a violation of copyright laws and show a blatant disregard for her explicit refusal to allow the use of her work. Currently, West has not provided any public comments regarding the lawsuit.
