In January, two musicians, Duval “D.Chamberz” Chamberlain and Kenley “Kass the Producer” Carmenate, filed a lawsuit against Ice Spice, alleging that her hit song “In Ha Mood” from the EP Like..? copied their original track “In That Mood,” which was released in July 2022. The lawsuit also implicated producer RiotUSA and major music labels. Recent court documents reveal that Ice Spice has now settled with D.Chamberz and Kass the Producer.
A motion filed in a New York federal court indicates that attorneys for both parties have reached an agreement to resolve the lawsuit. While the specific terms of the settlement remain undisclosed, it was stated that each party will cover their own legal costs and expenses.
In the original suit, D.Chamberz detailed the creation of “In That Mood,” which he first previewed on Instagram in August 2021. The song was briefly available on streaming platforms in early 2022 before gaining traction with the release of Boom Bap 2 Drill Rap that summer. D.Chamberz claimed to have performed “In That Mood” live in New York over 36 times prior to Ice Spice’s January 2023 release of “In Ha Mood,” asserting that the song received considerable airplay on local radio stations, thereby providing Ice Spice and her producer the opportunity to hear it.
The plaintiffs emphasized notable similarities between the two tracks, including analogous titles, shared hip-hop rap and drill styles, similar hook and chorus lyrics, as well as matching tempos and rhythms.
As 2023 concluded, Ice Spice made her debut performance of “In Ha Mood” on a prominent late-night television show, following the summer release of her first album, Y2K!.
